1. Scope

These Terms & Conditions apply to the use of this website and to purchases of digital products, coaching services, memberships and other services offered by Boris Schwarz through this website.

By purchasing a product or service, making a booking, or purchasing a membership, you agree to these Terms & Conditions.

Nothing in these Terms limits any mandatory consumer rights available to you under applicable law.

2. Services and Products

The website currently offers:

• Sex Without Fear – a digital book supplied electronically

• The Protocol – a twelve-week private coaching program including nine 75-minute 1:1 coaching sessions and the additional materials and support described on the relevant sales page.

• The Academy – an ongoing membership providing access to educational materials, resources and live implementation sessions as described on the relevant sales page.

The specific scope, price and features of each product or service are those displayed on the website at the time of purchase.

3. Prices and Payment

Prices are displayed in euros (€) unless otherwise stated.

Payment is due through the payment methods made available during checkout. Coaching services are paid in full in advance unless expressly agreed otherwise.

Any applicable taxes will be handled in accordance with applicable law.

An order or booking is considered accepted when you receive confirmation through the website or by email.

4. Digital Products

Digital products are supplied electronically. After successful payment, access may be provided through a download link on the website, by email, or through another electronic delivery method stated at checkout.

Digital products are licensed for your personal, non-commercial use only. You may not reproduce, distribute, resell, publish, share or otherwise make them available to third parties except where permitted by applicable law.

5. Coaching Services

Coaching is educational and developmental in nature. It is intended to help clients develop greater sexual confidence, competence and practical skills.

Coaching does not constitute medical treatment, psychotherapy, psychiatric care, diagnosis or other healthcare.

No particular outcome or result is guaranteed. Results depend on individual circumstances and on the client's participation and implementation.

If you have symptoms or concerns that may require medical or psychological diagnosis or treatment, you should consult an appropriately qualified healthcare professional.

6. The Protocol — 12 Week Coaching Program

The Protocol is a structured twelve-week coaching program comprising the components described on the relevant sales page at the time of purchase.

The program includes nine private coaching sessions. Sessions should normally be completed within the intended program period unless a different arrangement is agreed.

The program is intended for the individual purchaser and may not be transferred to another person without prior agreement.

8. The Academy

The Protocol Academy is an ongoing paid membership.

The current membership price is displayed before purchase. Unless otherwise stated at checkout, the membership renews automatically on a monthly basis until cancelled.

You may cancel future renewal of your Academy membership through the available account/subscription functionality or by contacting us.

Cancellation stops future renewals but does not normally result in a refund of membership fees already paid for a current billing period, except where required by applicable law.

Access to Academy content is personal to the member. Login credentials and protected materials may not be shared with third parties.

We may update, replace or expand Academy content and scheduling over time while maintaining the overall nature of the service.

9. Right of Withdrawal

Consumers may have a statutory right to withdraw from a distance contract within 14 days without giving a reason, subject to applicable law and statutory exceptions.

For service contracts, if you expressly request that performance begin during the withdrawal period, you may be required to pay an amount proportionate to the services already provided if you subsequently exercise your right of withdrawal. Once a service has been fully performed, the right of withdrawal may be lost where the statutory requirements for this have been met.

For digital content that is not supplied on a tangible medium, the right of withdrawal may be lost once supply has begun where you have expressly consented to immediate performance and acknowledged that you thereby lose your right of withdrawal, as required by applicable law.

To exercise your statutory right to withdraw, send a clear statement by email to boris.schwarz@mail.com. Sending your withdrawal statement before the withdrawal period expires is sufficient to meet the deadline. You do not need to explain your decision. If you withdraw, the payments received from you will be reimbursed without undue delay and no later than 14 days after being informed of your decision, subject to any lawful proportionate payment for services already provided.

10. Intellectual Property

Unless otherwise stated, all website content, educational materials, videos, written materials, downloads, course materials, Academy content, branding and other original materials provided through the services are owned by or licensed to Boris Schwarz.

Purchase of a product, coaching program or membership does not transfer ownership of intellectual-property rights.

Materials are provided for personal use only and may not be copied, recorded, distributed, sold, publicly displayed or commercially exploited without prior written permission, except as permitted by law.

11. Member Accounts

Certain services require a website member account.

You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

Access may be suspended or terminated where an account is used fraudulently, shared without authorization, used to infringe intellectual-property rights, or used in serious violation of these Terms, subject to applicable law.

12. Appropriate Use and Professional Boundaries

Clients and members are expected to communicate respectfully and use the services for their intended educational and coaching purposes.

Harassment, threats, abusive conduct, unlawful activity, unauthorized recording or distribution of sessions or materials, or serious violations of professional boundaries may result in termination of access or services, subject to applicable law and any mandatory consumer rights.

13. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

To the extent permitted by law, Boris Schwarz is not responsible for indirect or consequential losses resulting from use of the website, educational materials or coaching services.

Information and coaching provided through the services are not a substitute for professional medical, psychological, legal or other regulated professional advice where such advice is required.

14. Technical Availability

Reasonable efforts are made to keep the website, member area, digital downloads and Academy services available and functioning.

Temporary interruptions may occur due to maintenance, updates, third-party services, technical failures or circumstances outside reasonable control.

Where a purchased digital service is not supplied in conformity with applicable legal requirements, statutory consumer remedies remain unaffected.

15. Changes to These Terms

These Terms may be updated where necessary to reflect changes to the services, website, legal requirements or business operations.

The version applicable to a purchase is generally the version made available at the time the relevant contract is concluded, except where changes are required by law or validly agreed.

16. Governing Law

These Terms are governed by the laws of Hungary, without depriving consumers residing in another country of any mandatory consumer protections applicable to them under law.

Any mandatory rights concerning jurisdiction and dispute resolution remain unaffected.
